JOB PURPOSE:
Summary
According to related laws andregulations, internal policy and commercial principle, drafts and reviewsbusiness contracts and legal documents; provides professional support todepartments especially the AR collection dispute or contractual dispute;maintains company interest as well as reduces legal risk in order to ensurebusiness operation.
· To proactivelyoperate as business partner with the various functions of us providingprofessional legal advices as per all aspect of current business law andlegislative change;
· To beresponsible for preparing and reviewing contracts and other legal documents tomeet the business requirements and minimize the potential legal risks;
· To cooperatewith external agencies( eg, law firm) on all kinds of negotiation, mediation,litigation and investigation cases to protect the legitimate rights of company
KEY ACCOUNTABILITIES:
· Draft, reviewand translate contracts and other legal documentation to ensure all relevantlegislation is complied with, identify and minimize potential contractualrisks;
· Draft legaldocument, standard, regulations in accordance with law merchant, transaction compliance;
· Give legaladvice on all kinds of business related activities, including consumer promotion,interaction with customers, commercial events, etc;
· Understand company’sbusiness, provide legal counseling to all business dept. to avoid legal risks.
· Monitor athorough understanding of the legal development, perform legal research,communicate with various government authorities to understand the most recentregulatory developments, and advise various functional departments on the legalinterpretation, implications and opportunities for the company’soperations;
· Handle locallegal disputes, especially the AR collection dispute or contractual dispute,through negotiation, mediation or litigation;
· Review andimprove legal-related procedures and/or policies periodically to ensure theprocedures and/or policies in line with the development of business operation,the guideline of global policies and applicable laws and regulations;
· Complete thetasks line mgr assigns, keep track records and document
· Provide legalsupport on corporate matters;
· Provide legaltraining to staff.
· Conduct legalresearch
· Other relatedlegal assignments
JOB-HOLDER ENTRY REQUIREMENTS:
Education:
Bachelor degree in PRC law or above
Experience & knowledge:
At least 5+ years experience in reputable lawfirm or multi-national company as legal; experiences in construction machineryespecially in excavator industry is a big plus, competitor are preferred
Hands-on experience in AR collection dispute or contractual dispute
Core competencies:
PRC Bar Qualification is plus not a must;
Good understanding of PRC law, soundbusiness acumen and commercial awareness and practically-oriented;
Good communication skills in both English and Chinese (written & verbal);
Computer literacy, familiar with all Microsoft applications;
Self-motivated, hard-working, detail-minded, team player and ability to workindependently under pressure with minimum supervision.
